Most people assume that if something happened to them, their husband, wife or children could simply step in and handle their affairs. In reality, without a Lasting Power of Attorney in place, they have no legal authority to do so, even to pay bills from a joint account.
Two types of LPA
A Property & Financial Affairs LPA covers money, bills, property and investments. A Health & Welfare LPA covers medical treatment, care arrangements and day-to-day wellbeing. Most people need both.
It must be done while you have capacity
This is the critical point. An LPA can only be set up while you still have the mental capacity to make one. Once capacity is lost, it’s too late, and your family faces a lengthy and expensive Court of Protection application.
